— Welcome to RivalFit. These Terms and Conditions govern your use of the RivalFit mobile app and related services. By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use RivalFit. You must accept these Terms when you create an account.
— RivalFit is a competitive fitness platform that combines workout, running, and nutrition tracking with XP, leagues, leaderboards, a Prestige progression system, a social feed, and a marketplace of trainer-created programs. RivalFit provides tools and a community. It does not provide medical, health, or professional fitness advice.
— RivalFit is not a medical service and does not provide medical advice. The app, its content, exercise library, trainer programs, and any XP, missions, or challenges are for general fitness and informational purposes only. Exercise and dietary changes carry inherent risks. You should consult a physician before starting any exercise, nutrition, or fasting program, especially if you have a health condition. You take part in physical activity at your own risk, and you are responsible for exercising safely and within your own limits.
— You must be at least 18 years old to use RivalFit. By creating an account, you confirm that you are 18 or older and that the information you provide is accurate. Your date of birth is required at signup and is used to confirm eligibility and to place users aged 60 and above in the Golden Division, which you can opt out of.
— You are responsible for your account and for keeping your login secure. You agree to provide accurate information, verify your account when asked, and not share your account or impersonate others. You are responsible for activity that happens under your account.
— RivalFit offers Free, Pro, Elite, and Gym License plans. All new users receive a two-week Elite trial. After the trial, you choose a paid plan or continue on the Free plan. Paid subscriptions are purchased through a web-based checkout, not through in-app purchase, and are billed through our payment provider. Subscription prices and what each plan includes are shown at checkout and may change over time.
— Paid plans renew automatically for the period you select until you cancel. You can cancel through the method described at checkout or by contacting us, and cancellation takes effect at the end of your current billing period. Except where required by law or stated by us, payments are non-refundable. If prices change, we will let you affected subscribers know as described at checkout.
— RivalFit uses an XP system that feeds Prestige progression for all users and state tier ranking for paid users. Free users can see their position as a ghost rank but do not climb the state tier until they upgrade. XP rules, tiers, seasons, leaderboards, and badges are set by RivalFit and may be adjusted, reset on schedule, or corrected. XP and rankings have no cash value and cannot be exchanged for money.
— You agree to earn XP and rankings honestly through your own genuine activity. You may not fake activity, manipulate GPS or tracking, use bots or scripts, exploit bugs, or otherwise cheat the XP or league systems. We may adjust XP, remove rankings or badges, or suspend accounts that violate fair play, and our XP floor is zero.
— The Marketplace lets you buy training programs created by trainers. Trainers, not RivalFit, are responsible for the content, quality, and safety of their programs. RivalFit provides the platform and processes the transaction. Ratings, reviews, and program details are provided to help you choose, and you are responsible for training safely within your own ability.
— If you sell programs as a trainer, RivalFit applies a platform fee. There is no platform fee charged to a user when they purchase a program. Instead, the platform fee is applied to the seller when the seller withdraws or is paid out their earnings. The seller fee is a stated percentage that depends on whether the seller is on a premium plan, as described in the app. RivalFit also may charge featured placement fees and subscription commissions as described to trainers.
— You keep ownership of the content you post, such as workout clips, comments, and photos. By posting, you grant RivalFit a license to host, display, and share that content within the app to operate the service. You are responsible for the content you post and confirm you have the right to share it. Do not post content that is unlawful, harmful, misleading, or that violates the rights of others.
— RivalFit includes a social feed and messaging. You agree to interact respectfully and not to harass, bully, threaten, or abuse others, or post inappropriate or unlawful content. We may moderate, hide, or remove content, and suspend or remove accounts, that violate these Terms, to keep the community safe.
— If you have a Pro subscription and a connected trainer, you can exchange messages with that trainer in the app. Messages should relate to your training. We may access messages as needed to run the service, provide support, resolve disputes, and enforce these Terms.
— You agree to use RivalFit lawfully and not to misuse it. You may not attempt to gain unauthorized access, disrupt the service, reverse engineer the app except where allowed by law, copy or resell the service, or use it for any unlawful or harmful purpose.
— RivalFit relies on third-party services, including our payment provider Stripe, sign-in providers Google and Apple, mapping and GPS services, and cloud hosting. Your use of features powered by these services may also be subject to their terms. We are not responsible for third-party services we do not control.
— RivalFit, including its name, design, software, XP and league systems, and original content, is owned by RivalFit or its licensors and is protected by law. Except for the rights we grant you to use the app, and your own content, you receive no ownership of the platform.
— We work to keep RivalFit available and reliable, but we do not guarantee it will be uninterrupted or error-free. Features are being released in phases, and we may add, change, or remove features, seasons, leagues, or plans as the platform develops.
— RivalFit is provided on an as-is and as-available basis. To the fullest extent permitted by law, we make no warranties about the app, its content, trainer programs, XP or rankings, or any fitness or health results, and we disclaim all implied warranties. You are responsible for your own health and safety.
— To the fullest extent permitted by law, RivalFit and its operators are not liable for any indirect, incidental, or consequential damages, or for any injury, health outcome, or loss arising from your use of the app, your participation in exercise or nutrition activities, trainer programs, or content from other users.
— You agree to hold RivalFit and its operators harmless from claims, damages, and costs arising from your use of the app, your content, your activities, your violation of these Terms, or your violation of the rights of others.
— You may stop using RivalFit and delete your account at any time. We may suspend or end your access if you violate these Terms or to protect the platform and its users. Provisions on payments, disclaimers, limitation of liability, and intellectual property continue after termination.
— These Terms are governed by the laws of [INSERT STATE], United States, without regard to conflict of law principles. (Operator to confirm governing jurisdiction with counsel.)
— We may update these Terms from time to time. We will post the updated version in the app or on our website and update the effective date below. Continued use of RivalFit after changes take effect means you accept the updated Terms.
